Conspiracy

San Diego Conspiracy Defense Lawyer

One charge that often makes its way into drug cases is conspiracy. You can be dragged into court and charged with conspiracy even if you only had a minor role in an illegal activity. At my law office in San Diego, I offer a free initial consultation to explain the consequences and defenses of conspiracy charges.

Conspiracy is an agreement to commit a crime. You don't have to complete the crime to be found guilty. You don’t need to know the other people involved in the conspiracy. All prosecutors have to show is that you got together with someone else and planned to commit a crime.

Conspiracy charges are often included in federal indictments for major drug cases.

Consequences of a Conspiracy Conviction

If you are found guilty of a conspiracy charge, you can be held accountable for the whole conspiracy. For example, if you further the aims of a large drug trafficking or importation operation, you can face federal drug trafficking charges even if all you did was mail a package. In fact, you could be charged with two crimes: conspiracy for helping to plan the crime and mail fraud for mailing the package.

Defenses in Conspiracy Cases

As your lawyer in a conspiracy case, my goal would be to limit your involvement in the criminal activity. A common defense I could argue is that you were not aware of what the other people were doing.

Prosecutors usually cast a wide net with conspiracy charges. However, that doesn't mean they can prove those charges in court.
