Domestic Violence

San Diego Domestic Violence Charges Defense Lawyer

Once the police get involve in a domestic altercation, whether or not either of the parties called, the chances are that someone will get arrested and go to jail. After bail is set you can be released after posting bail. When the police come do not try to talk your way out of it. It is extremely important that you do what they tell you and request to speak to an attorney. Often a detective or an investigator from the City Attorney or District Attorney's Office will attempt to contact the parties to get additional information to be used against the person charged in court. Try to contact a lawyer as soon as possible.

Once allegations of domestic violence are made, the police try to get as much information as possible including physical examinations, pictures, and statements. The alleged victim can't change his or her mind and simply ask the police to forget about a situation that was reported to them. It is out of both parties' hands. The legal system will take over. I have more than 23 years of experience protecting the rights of men and women charged with domestic violence and related offenses such as spousal battery, domestic assault, family violence and spousal abuse. I can also defend you against charges such as the making of terroristic threats and telephone or Internet harassment.

Police and Prosecutors Take Domestic Violence Very Seriously

All allegations of domestic assault or spousal battery in Southern California are taken seriously. Cases that involve physical injuries are treated even more harshly. The consequences of a domestic violence charge can range from a 52 week domestic violence class, pubic work service, probation, jail or prison time in serious felony cases.

In determining the sentence they will seek, the prosecutor will take a good look at your personal and criminal history. Is this your first or second offense or your fifth? Have there been allegations of previous unreported domestic violence? Is there an escalating pattern of violence and serious injuries like broken bones and lacerations? In cases involving weapons, additional charges may apply.

Addressing the Underlying Issues

As a lawyer, I need to talk to the reporting person if possible. Keeping the lines of communication open can be an important part of resolving the dispute in a favorable manner. I often try to talk to the alleged victim myself so that I can be sure of exactly what the story is from his or her perspective.

Drugs, alcohol, depression and stress can all trigger altercations that may end up in domestic violence charges being filed. I understand and will work to get you the treatment you need, if you want it. It can not only help your case, but it can help the entire situation tremendously.

Challenging Domestic Violence Protective Orders

If you want to work out your marital or domestic problems there are things that can be done, but not while a protective order is in place. A protective order (also known as a restraining order) can make it difficult or impossible to maintain free access to your home, your belongings and your children. I can help you fight the issuance of a domestic violence protective order or to have an existing order modified or lifted.
